When a property condition causes preventable harm
Property owners and occupiers may have duties to lawful visitors. A premises claim turns on the condition that caused the injury, who controlled the property, what they knew or should have known, and whether a reasonable warning or repair was provided.
Conditions that may lead to a claim
- Slippery floors, unsafe stairs, or broken walking surfaces
- Inadequate lighting, security, warnings, or maintenance

How notice and responsibility are evaluated
Incident reports, photographs, surveillance video, inspection practices, maintenance records, and witness accounts may help show how long a hazard existed and who had responsibility for it.

Preserving evidence promptly
Hazards can be repaired and video can be erased quickly. Report the incident, identify witnesses, preserve footwear and clothing, and request that relevant evidence be retained.
